Terms of Service

Welcome to Amaiie (“Portal”, “we”, “our”). Use of the Portal constitutes full acceptance of these Terms of Service (“Terms”).

The Portal allows private users and real estate agencies to publish listings for properties for sale, rent, or other real estate transactions.

1. Acceptance of the Terms

By accessing or using the Portal, you confirm that you have read, understood, and accepted these Terms, our Privacy Policy, and any guidelines published on the site.

If you do not accept these Terms, you must not use the Portal.

2. Description of the Service

The Portal provides an online platform that allows users to:

  • publish property listings;
  • edit and manage their listings;
  • browse listings published by other users;
  • contact advertisers and real estate agencies.

The Portal acts solely as a technical intermediary and does not participate in negotiations, sales, leases, or agreements between users.

3. Requirements for Publishing Listings

Users who publish a listing declare and warrant that:

  • the information provided is true, accurate, and up to date;
  • they have the right or authorization required to publish the listing;
  • the content does not violate applicable laws, third-party rights, or regulations;
  • the listing does not contain misleading, offensive, defamatory, or fraudulent content.

The following are prohibited:

  • false or misleading listings;
  • non-existent properties;
  • content that violates the GDPR or privacy laws;
  • discriminatory, offensive, or defamatory content;
  • illegal or fraudulent material.

4. Verification and Liability

The Portal may perform limited checks on users and real estate agencies, including phone verification or basic controls.

However:

  • the Portal does not guarantee the absolute accuracy of published listings;
  • it does not perform technical, cadastral, zoning, or legal checks on properties;
  • it does not guarantee the identity, reliability, or solvency of users;
  • it is not responsible for negotiations, contracts, payments, or disputes between users.

Users use the Portal at their own sole risk.

5. Moderation and Removal of Content

The Portal reserves the right, at its sole discretion and without obligation to give notice, to:

  • modify, suspend, or remove listings;
  • limit the visibility of content;
  • suspend or close user accounts;
  • cooperate with competent authorities in case of legal violations.

Listings may be removed, among other reasons, in case of:

  • violation of these Terms;
  • suspected fraud;
  • violations of the GDPR or privacy regulations;
  • well-founded reports of false or defamatory content;
  • misuse of the Portal.

Users who publish false, fraudulent, or misleading listings may be permanently banned from the Portal with no possibility of account reactivation.

6. Availability of the Service

The free service is provided “as is” without any guarantee of continuity.

The Portal reserves the right to:

  • temporarily or permanently interrupt the service;
  • modify platform features and characteristics;
  • limit or suspend access for free users at any time.

Except as required by law, the Portal shall not be liable for interruptions, data loss, or malfunctions.

7. User Responsibility

The user is solely responsible for:

  • published content;
  • information entered in listings;
  • relationships established with other users;
  • use of their account.

Users must keep login credentials confidential and must not use the Portal for unlawful or fraudulent activities.

8. Limitation of Liability

To the extent permitted by law, the Portal shall not be liable for:

  • direct or indirect damages arising from use of the service;
  • loss of business opportunities;
  • content published by users;
  • fraudulent conduct by third parties;
  • errors or omissions in listings.

Users acknowledge that any real estate transaction takes place exclusively between the parties involved.

9. Intellectual Property

All content, trademarks, logos, graphic elements, and software on the Portal are protected by applicable intellectual property laws.

Unauthorized copying, reproduction, or distribution of Portal content is prohibited.

Users retain rights to uploaded content and grant the Portal a non-exclusive license to publish and display it.

10. Privacy and GDPR

Personal data is processed in compliance with Regulation (EU) 2016/679 (“GDPR”) and applicable law.

Users must not publish third parties’ personal data without authorization.

11. Changes to the Terms

The Portal reserves the right to modify these Terms at any time.

Changes take effect on the date of publication on the site. Continued use of the Portal constitutes acceptance of the changes.

12. Governing Law and Jurisdiction

These Terms are governed by Italian law.

Unless otherwise required by law, disputes relating to use of the Portal shall be subject to the courts of Osaka.
